I wish my company attorney could understand the basic ENGLISH instructions. Worst part, still doesn't admit his mistake and keeps pointing to the receipt issued by USCIS.
Btw, I took Infopass appointment and went today to ask what should I do....given USCIS has issued receipt notice
The officer responded similar to my attorney's response, stating given that USCIS has issued receipt, they are working on my appl and I may not need to send the fee..BUT he admitted that the fee was required..
In short, still not sure what to do....
I think both your attorney and the Infopass official are right. The app fee is part of the initial evidence (documents) that are verified before the case is accepted. Since the receipt has been issued it seems the receipting agent has overlooked that the fee was required. But again, this is USCIS that we are talking about!!
Just my 2c and not a recommendation one way or the other!!

oh! what a luck. I have not come across anyone who has this situation. My guess is that you should have no problem for 1 year extensions but you cannot get 3 year extensions because 3 year extensions are only for people who cannot file for i485 because of retrogression and you do not meet that criteria and According to Yates memo you are eligible for 1 year extension.

If you decide to go back to school nothing will happen to your wife's I-485 application. She is eligible to an EAD as long as her I-485 is pending.

I know this is not a good question as there is no time frame for GC process?
But please share your experience;

$1000 is a lot for Premium Processing and VSC is profiting a lot from this. They are running a business for sure....
Its only extensions which are a long time.
USCIS is self-funded from application fees. They don't get any other funding as far as I know. So, sure they are running a business.
I know its not cheap, but atleast there is a way. I have been in this long enough to know times when it took a long time without an option of premium processing.
You can always make your employer pay for the fees.

Hello Guys,
Does any one here has Newark NJ as their ASC? Reason is my notice date is august 27th from TSC and I haven't received my FP notice yet. My wife has the similar issue as well. I've called USCIS atleast twice but they are not ready to open service request and are saying that the ASC must be busy.
I wanted to find out if any one of you here has notice date after august 27th and have already got FP notice from Newark (NJ) ASC.

I think it matters and you probably might get an RFE if you dont provide evidence that you are qualified for the advertised job.
You can try to get an affidavit from some of your older colleagues.
It is EB3 (PD 2001) and Lc did say that 3 years of experience and my first job almost have 2 years 8-9 months of experience. So I was thinking that USISC should not mind for letter of eperience for 3 remaining months..Current job ..I have been working now for 6.5 years....
Does it matter..Do you think it really matters..

On March 12 2009 I got an query on my I-485.
Requesting discrepancy in the labor applied on Nov'7 2002 and present working place.
My company(abc ltd) applied labor on Nov'07 2002 while I was working at the clients(xyz) place in Los Angeles.
I got my I-140 approved on Feb'15 2006, while I was with the same client(xyz) at that time.
On Dec'04 2006 I moved to Detroit, started working with different client.
RFE goes like this.
The Documentation submitted with your application and/or a review of service records indicate that you no longer reside in the same state or geographical location as the underlying form i-140 immigration petitioner and /or job location specified by your intended permanent employer.
There fore submit a currently dated letter from your original form I-140 employer which which address this discrepancy.
I am still working with the same employer who filed my labor certification.
Any gurus who can suggest me on the query would be greatly appreciated.
As per yates AC21 memo, job location should not be a problem. Also refer to murthy's FAQ on AC21. Your attorney should respond as per this memo.

Well there is a thread here talking about the pros and cons of multiple 485 filing so that means it can be done. As far as i have read its not illegal but it might delay the process. Different lawyers have diff opinion. Both our lawyers agreed for multiple filing and so to be on the safe side(one has an early PD and the other's job is more stable) we are filing 2 485s, but only one EAD and AP.

your lawyer (and most of them including some famous on wwww) are dhakkan. They have no clue what's going on with vb. They just know how to fill some some form , that also they screw lot of time.
