I have EB2 i-140 approved with PD Dec. 05. I am planning to change the employer.. was just waiting to see if CIR gonna help.. but looks like its not. If I change job now, I will have to do labor, i140 once again!! might be able to maintain PD. .. my question is... I believe that in Octo. 06, new quota for GC will be available. What are the guesses that the PD will become current (at least for Eb2 India) in Octo 06?? Some educated guesses are highly appreciated.
I wish same. But it is 200% not possible. We are getting lot of Labour approvals from BEC's . If P.D dates stays as 2003 Jan it is great.
I think there is much possibility for more retrogression. It may go back upto 2002 Jan for EB2 also.

Well I seem to have run into more confusion...
I've updated the firmware to 2.0 and I'm not sure if its changed the menu in the D70 or not but I was looking up the "exposure bracketing" that you suggested and on page 88 of the manual it shows (in the top image) the "Menu" opened with the (i believe its the Details tab, it has the small pencil), and then it shows the "12 BKT Set" titled at the top... followed by the Flash & Exposure settings below it... My menu doesn't show any of these... infact alot of my menu looks different than the manual since the update, which if I'm not mistaken was one of the updates within the firmware. Only now I don't know where to find what the manual shows.

My wife's RFE was because they saw she used FNU as her 1st name. They wanted to know if she wanted to keep the same FNU name for GC or not.
Also they wanted proof of marriage (which I had already sent them in 2007).

Also, at this point there are some questions lingering around your 'consulting' agency. I'm pretty sure a 4 yr. degree from an accredited college/university is considered equivalent to BS here. I really have suspicions on the real cause that's being presented to you.
You may want to check if your agency is employing others and if so, get in touch with one of them and gather facts.
I am no expert on saving your status, hence I am not commenting.

My friend Who applied in EB3 after me will be applying for citizenship next year while I am waiting for my I-485.
Another one same company , eb2, same credential as me , later receipt Date, applied after me in eb2, got his GC five months back.

At what stage am I determined as EB2 or EB3? Is it at the labor or I-140 stage?

1. When did you go for the stamping?
2. Does this mean that you just fill the online form and then go to teh embassy on the designated day. No need to go to India and do this :"If you are submitting your forms to our application centre in Mumbai you must submit at least 3 working days in advance."

I got my visa stamping from mumbai conuslate. Its pretty easy. Take an appointment through VFS by getting a HDFC bank receipt after paying the fee. Check on the VFS site when is the available date. and then follow the link and book the appointment. You will get forms which are populated. When you enter the consulate they will hand you the original form which you filled and then ask you to fill whatever you had missed out using your pen. you have to wait till your number calls out and then you get visa stamped and passport posted.

Hello all,
I am not able to get my passport renewed. Indian consulate in Houston said that it will take atleast 4 weeks to get a passport.
Pl help. Can I go ahead and apply for my 485?
Also, would you know anything about copies of affidavits?

You need copies of your passport for 485. Send the copies and then send the passport for renewal. If RFE comes, you will have the new passport by then.
Check with your lawyer, I am sure it is not a big deal. Please consult your lawyer.

My understanding is:
I think in VA you are partially protected against the non compete law.
If contract says it is limited to maximum of 2 years and you can not work for some specific companies, unfortunately non comptete law is valid.
But VA gives a write to earn for your living. If you can proove that if you might not have taken this job, you would not be able to earn. Only you can challenge the non compete law.
Search on google, you might get good reasonable description of non compete law in VA.

Guys who get RFE should keep a close watch on the receipt of the notice within 10 days from RFE issue date, if you don't receive it make sure you call them and get the RFE faxed or resent, the deadline to RFE respond wont be extended no matter what you do, this is based on my personal experience.
I got an RFE on May15'09, till date i have not received it, i did manage to get the RFE contents faxed to me after waiting 15 days but the medical form is lost somewhere, i am still working on responding to the RFE before June14'09 deadline.

Dear All.
I have a couple of queries and would appreciate your guidance in the matter.
-I have an approved H1B extension but my H1B visa in the passport has expired. Presently I do not want to use my EAD. When travelling outside the country can I re-enter the US using my Advance Parole or do I have to get my H1B visa stamped in the passport.
-Our son is 15 years old. He does not have a social number as we did not apply for EAD. His H4Visa on the passport has expired. Now when he travels outside the country, can he use his travel document. How does it work, or does he have to maintain his H4 status and get his visa stamped. Please advise.:)

I may travel to India in Oct on AP for first time. I am working on EAD and changed employer with AC21. I will use AP at POE.

It will take weeks to write the draft of the bill. Then atleast 1 month debate about the bill. So it will take 2 to 3 months even if everything is positive. Even if they are serious they may not have enough time to pass CIR. So 2010 may be right time for CIR.

I believe if your H1 expires before your I-140 approval and your PD is less than 365 days you will not get 1 year extension. If I-140 premium process reinstates that is only chance otherwise you have to take vaccation and come back.

Your response to the July Visa Bulletin fiasco made me very pleased and re-instilled the hope in me that I had lost as a result of the recent announcements by USCIS to stop accepting Adjustment of Status applications.
It is indeed appalling that the various problems faced by highly skilled legal immigrants get lost in the cracks of the system and do not get any media coverage.
I have been in the U.S for approximately 9 years now. I graduated with a Masters in Engineering from a highly ranked school here, always played by the rules and still am stuck in the backlog delays and the bureaucracies of the immigration process.
The July visa bulletin released on June 13th a gave me and others a ray of hope which was crushed after USCIS stopped accepting applications on July 2nd. I have spend huge amount time, effort and attorney's fees preparing all the paperwork and submitting it to USCIS on July 2nd.
Again I want you to know how much me and other skilled workers in the same situation as me, appreciate your taking up this issue with Dept of State and USCIS. Thank you so much for your help in this critical hour. Please help us in resolving this issue and also discuss this with your colleagues in congress so they may also take up this issue with the Federal government agencies.
